Subject: 9538/Zoning/RT-Resi Townhouse/Statement of Intent Date: Mon, 27 Feb 1989 12:20:00 -0500 ORDINANCE NO. 9538 AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS TO INCORPORATE INTERPRETIVE LANGUAGE, AMENDING ARTICLE V, SECTION 121 RELATIVE TO THE STATEMENT OF INTENT. _______________________ WHEREAS, The City of Chattanooga Board of Appeals for Variances and Special Permits has requested the staff to incorporate interpretive language into the RT-1 Residential Townhouse zone portion of the Chattanooga Zoning Ordinance; and WHEREAS, the Chattanooga-Hamilton County Regional Planning Commission recommends amending the provisions of the Zoning Ordinance governing the RT-1 Residential Townhouse Zone; NOW, THEREFORE, SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, known as the Zoning Ordinance, be and the same is hereby amended as follows: (a) That Article V, Section 121, be amended by deleting said section in its entirety and substituting in lieu thereof the following: "Statement of Intent: It is the intent of this section to provide regulations for the development of townhouses (also called rowhouses and "attached" homes) in a manner which is attractive, efficient, and compatible with surrounding development. It is also the intent of these regulations that the underlying real estate may be divided into small lots so that each unit can along with the underlying property, be individually sold and owned on a "fee simple" basis, although said units may also be sold as condominiums. It is further intended as a policy that any townhouse development of more than 8 units should be located within 500' of a major arterial or collector as shown on the General Plan most recently adopted by the Planning Commission." (b) That Article V, Section 122, subsection (1) be amended by deleting same in its entirety and substituting in lieu thereof the following: "(1) Townhouse dwellings, excluding manufactured homes, provided that such townhouse dwellings shall meet all structural standards set forth in the Standard Building Code adopted by the City of Chattanooga for townhouse construction." (c) That Article V, Section 123, subsection (2) be amended by deleting the following: "(2) A minimum building site area for townhouse dwellings shall be thirteen hundred and fifty (1350) square feet." And substituting in lieu thereof the following: "(2) A minimum building site area for each townhouse unit shall be one thousand three hundred fifty (1350) square feet." (d) That Article V, Section 123, subsection (3) be amended by deleting the following: "(3) The minimum lot width shall be eighteen (18) feet." And substituting in lieu thereof the following: "(3) The minimum building site width for each unit shall be eighteen (18) feet." (e) That a new subjection (9) be added to Article V, Section 123, as follows: "(9) Frontage on a dedicated public street of the individual units shall be required only when the underlying properties are individually sold as lots along with the units on a fee simple basis." SECTION 2. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage, the public welfare requiring it.
